Terms of service

Welcome to Bhingarde. “We”, “us”, and “our” refer to Bhingarde. These Terms of Service (“Terms”) govern your use of our website, store, products, and services (the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019 or any other applicable Indian law.

1. Eligibility and Account

You must be 18 years or older to use the Services or make a purchase. Minors may use the Services only under the supervision of a parent or guardian.
The information you give us must be accurate, current, and complete.
You are responsible for keeping your account login secure and for all activity on your account.
You may not transfer or sell your account to anyone else.

2. Our Products

We try to show our products as accurately as possible. Colours may look different depending on your screen.
Many of our products are made from natural materials or are handcrafted. Slight variations in colour, texture, size, and fragrance are natural and are not defects.
Our products are for devotional, ritual, and decorative use. We make no claims about spiritual, health, or other outcomes from their use.
We may change product descriptions, discontinue products, or limit quantities at any time.

3. Orders

Placing an order is an offer to buy. Your order is accepted only when we confirm it.
We may decline or cancel an order, for example if a product is out of stock, a price is wrong, or we suspect fraud. If we cancel after you’ve paid, we will refund you in full.
Products are sold for personal use only, not for resale.

4. Prices and Payment

All prices are in Indian Rupees (₹) and include GST. Shipping charges, if any, are shown at checkout before you pay.
The price you pay is the price shown when you place the order.
Prices and offers may change without notice. Offers are subject to their own terms. Where an offer’s terms conflict with these Terms, the offer’s terms apply.
Payments are processed securely by our payment gateway partner. We do not store your card or UPI details.
You confirm that you are authorised to use the payment method you provide.

5. Shipping and Delivery

We currently ship within India only.
Delivery times are estimates. We are not responsible for delays caused by courier partners or events beyond our control, such as natural disasters, strikes, or government restrictions.

6. Cancellations, Returns, and Refunds

Cancellations, returns, exchanges, and refunds are handled as per our Return and Refund Policy.
Approved refunds are processed to the original payment method within [7–10] working days.

7. Intellectual Property

All content on the Services, including text, images, designs, logos, and product photos, belongs to Bhingarde and is protected under Indian and international intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, or distribute our content without our written permission.

8. Reviews and Feedback

If you submit a review, photo, or other feedback, you allow us to use it for any purpose, including marketing, without payment.
Your content must be your own. It must not be false, offensive, defamatory, or infringe anyone’s rights.
We may remove content that breaks these Terms.

9. Third-Party Links and Tools

The Services may link to or include tools from third parties. We are not responsible for their content, policies, or practices. You use them at your own risk.

10. Prohibited Use

You must not:

Use the Services for any unlawful or fraudulent purpose
Infringe our or anyone else’s intellectual property
Upload viruses or harmful code
Scrape, copy, or collect data from the Services using bots or automated tools
Impersonate any person or give false information
Harass, abuse, or harm our staff or other users
Interfere with the security or working of the Services

We may suspend or close your account if you break these Terms.

11. Errors and Inaccuracies

Information on the Services may sometimes contain errors in pricing, descriptions, or availability. We may correct these at any time, including after an order is placed. If we cancel your order because of such an error, we will refund you in full.

12. Disclaimer

The Services are provided “as is” and “as available”. We do not guarantee that they will be uninterrupted, error-free, or fully secure. This does not affect your statutory rights as a consumer.

13. Limitation of Liability

To the extent permitted by law, our total liability for any claim related to a product or order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under Indian law.

14. Indemnity

You agree to compensate Bhingarde for any loss or claim arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

15. Termination

We may suspend or end your access to the Services if you break these Terms. Sections on intellectual property, liability, indemnity, and governing law continue to apply after termination.

16. General

Severability: if any part of these Terms is found invalid, the rest remains in force.
Waiver: if we don’t enforce a right, we have not given it up.
Entire agreement: these Terms, together with our Privacy, Shipping, and Return and Refund Policies, form the full agreement between you and us.
Assignment: you may not transfer your rights under these Terms. We may transfer ours.
Communications: you agree that we may contact you electronically by email, SMS, or WhatsApp about your orders and account.
